The association has been operating in the market for many years and in the sole territory of Italy, it has 25 branches. The Italian Authority on Fair Competition examined the case of the UEJM. Its advice was requested for the evaluation of the alleged connection with the Libera Università di Cultura Europea (LUCE) incorrectly indicated as an institution authorised to grant recognised degrees and qualifications in Italy. The Authority ruled that the ad appeared on the website was misleading. Afterwards, with the proceeding n. 15.346 of 11th of April 2006, the Italian Authority sanctioned the non-observance of the first measure and ruled the corresponding monetary fine. The Italian Ministry of University Scientific and Technical Research clarified that the qualifications awarded by this institution cannot be recognised in Italy for three main reasons: first of all, because the Italian branches are not affiliations of foreign accredited universities; secondly, because they are not accredited by the Italian Ministry; finally, because the UEJM is not recognised in the Belgian Higher Education system. It is important not to confuse the UEJM with the Libera Università Mediterranea ‘JeanMonnet’, located in Casamassima (Bari), which is an officially recognised institutionin Italy.

33. Université Européenne Jean Monnet a.i.s.b.l.

Questa associazione ha come obiettivo quello di “dispensare corsi di formazione
post-secondaria di elevata qualità professionale e rilasciare i titoli corrispondenti in
tutti i settori non trattati o parzialmente trattati dal sistema formativo tradizionale,
soprattutto quelli relativi alle nuove professioni” e per questo “eroga i suoi corsi
attraverso diversi Istituti associati, presenti sul territorio europeo. Detti istituti operano
in totale autonomia, nel rispetto delle regole dello statuto ''Jean Monnet'', e accettano
che la direzione ''Jean Monnet'' eserciti su di loro un’azione di controllo e vigilanza”.
Inoltre, sempre nel sito dell’associazione si legge che “l’UEJM non fa parte
degli atenei universitari statali o equiparabili, autorizzati a deliberare sui titoli accademici
che sono protetti nel loro utilizzo o nell'esercizio della professione relativa. Pertanto i titoli da essa rilasciati non sono automaticamente equipollenti”184. Sul
mercato ormai da parecchi anni, l’associazione e gli istituti legati a essa (solo in
Italia ne vengono segnalati 25), hanno subito provvedimenti da parte dell’Autorità
Garante della Concorrenza e del Mercato. L’intervento dell’Autorità è stato richiesto
per valutare le informazioni contenuto nel sito della UEJM dove era presente
un collegamento con la ''Libera Università di Cultura Europea - LUCE'', indicata “erroneamente”
come istituzione autorizzata al rilascio di lauree e titoli riconosciuti.
L’Autorità ha ritenuto che il messaggio pubblicitario descritto e diffuso dall’associazione
''Université Européenne Jean Monnet'' costituisse una fattispecie di pubblicità ingannevole.
Successivamente, con Provvedimento n. 15346, datato 11 aprile 2006, è
stata contestata l’inottemperanza al primo provvedimento e irrogata la relativa sanzione.
Il MURST precisa che i titoli rilasciati da questa istituzione non possono
essere sottoposti a riconoscimento nel nostro paese, sia perchè le istituzioni operanti
in Italia non sono filiazioni di atenei esteri riconosciuti, sia perchè esse non sono
accreditate presso il Ministero e inoltre perchè questa istituzione non è una università
riconosciuta del sistema belga di istruzione superiore (come confermato più
volte dal centro Naric185). Da notare come “la UEJM tenterebbe di confondersi con
la ''Libera Università Mediterranea ‘Jean Monnet’'' di Casamassima (Bari), quest’ultima
legalmente autorizzata dal Ministero dell’Istruzione, dell’Università e della
Ricerca”186.
